If you've clicked through to this page, you're probably contemplating a purchase of residential real estate, and I'd like to just take a moment of your time to explain the facts of Buyer Agency in general, and specifically how it applies to Maryland real estate law.  As you will see, if you are contemplating any type of real estate purchase, enlisting the services of an Exclusive Buyers Agent is a wise consideration.

Introduction to Agency

In the state of Maryland, Brokers, and the real estate agents, acting as independent contractors on their behalf, may represent buyers and sellers. For any one transaction, however, an agent may only represent one side, e.g. either the buyer or the seller.

Further, in order to place an offer on any property, if you use an agent to assist you (and you really should, because it doesn't cost you a dime to be represented), you will need to sign some form of a Buyer Broker Agreement.  Without having entered into this Agreement in writing, an agent cannot legally offer a sales contract to a Seller on your behalf.

So the bottom line is this: If you're a serious Buyer, you need to engage the professional services of an agent, in writing, to assist you as your Buyers Agent in the home buying process by executing a Buyer Broker Agreement.

What services can you expect from your Exclusive Buyers Agent?

1.  Your agent will represent you and only you. 100% of their fiduciary duty will be to you.  In other words, your agent will be working at your side, advising you every step of the way through your real estate purchase.  Your agent's personal goal should be to ensure that the transaction process runs smoothly for you -- from identifying and coordinating visits to see potential homes all the way through to settlement.

2. After your contract has been accepted by the Seller, your Buyers Agent will assist you by scheduling termite, home and radon inspections, using the contractors you choose, and should personally meet with the inspectors in the field in order to convey all pertinent information to you in a timely manner.

3. Your Buyers Agent will work with your lender and your title company to ensure that established timelines are met and that scheduled settlement dates occur as planned.
